Background

In England and Wales, divorcing couples often have to apply to the Financial Remedies Court (FRC) for a binding decision on how to divide their matrimonial assets.  The court process traditionally involved three hearings: a First Appointment to identify the issues, a Final Hearing (trial) where a judge imposes a decision, and—crucially—a middle stage called a Financial Dispute Resolution (FDR) hearing.

 

The FDR hearing offers a structured opportunity to settle the case. Each party presents their position on a 'without prejudice' basis, and the judge gives an indication of what the likely outcome would be if the matter proceeded to trial. This indication can often help parties reach agreement and avoid the cost and stress of a final hearing.

 

However, due to growing demand on the court system, delays in listing FDRs have become common—sometimes adding months of uncertainty and expense. In response, many have turned to private FDRs, where the parties jointly appoint a former judge or senior lawyer to conduct the hearing outside the court system.

 

Until recently, this option was often limited to high-value cases.

 

We, however, now offer access to experienced practitioners - who all are part-time FRC judges  - sitting in a private capacity at a more affordable rate.  Our service enables parties and their legal teams to obtain a prompt, expert indication to support settlement, without the delays of the public court system.

Private FDR hearings involve a neutral third party mediator (we only use actual qualified judges), who provide an indication to the divorcing parties of the likely outcome of their case.

Is Private FDR legally binding?

Private FDR results can be legally binding if both parties and their lawyers are content with the outcome.  The agreed outcome can be sent to the Court for the Court's formal approval.
